Terms of Service

1. Agreement to Terms

By signing up for or using BonicBD ("the Service"), you ("Customer", "you") agree to these Terms of Service. If you don't agree, please don't use the Service. These Terms form a binding contract between you and BonicBD ("we", "us"), operated from Patuakhali, Bangladesh.

2. The Service

BonicBD provides hosted server-side Google Tag Manager containers, first-party tracking domains, conversion API routing, and an analytics dashboard. We provide the infrastructure; you (the Customer) configure tags, triggers, and destinations through your GTM workspace.

3. Account Registration

You must provide accurate registration information. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at bonicbdsgtm@gmail.com if you suspect unauthorized access.

4. Plans, Billing & Renewals

• Plans are billed monthly or annually in advance, in BDT (or USD for international customers via invoice).
• Annual plans receive a 10% discount over monthly pricing.
• Renewals occur automatically on the billing date. You will receive reminder notifications 7 days before renewal.
• Failure to pay by 3 days past due date may result in service suspension. Suspended accounts can be reactivated within 30 days by clearing dues.
• Plan upgrades take effect immediately and are prorated. Downgrades take effect at the next billing cycle.

5. Usage Limits & Fair Use

Each plan includes a monthly request quota. Exceeding your quota triggers an alert and grace window. Sustained overage may require an upgrade. We reserve the right to throttle or suspend accounts whose traffic patterns indicate abuse, attack origination, or non-tracking-related use of the Service.

6. Acceptable Use

You agree not to use the Service to:

• Track users without their consent where consent is legally required
• Process payment card numbers, government IDs, health records, or other regulated data classes through tag payloads
• Send fraudulent conversion events to ad platforms or violate platform policies
• Run malware, phishing, illegal content, or any service prohibited by Bangladeshi law
• Reverse-engineer, resell, or sublicense the Service without written permission

7. Customer Data & Ownership

You retain all ownership of data flowing through your tracking subdomain. We process this data solely as your processor to deliver the Service. See our Privacy Policy for details.

8. Service Level & Support

We target 99.9% monthly uptime for tracking endpoints. Scheduled maintenance is announced in advance and excluded from uptime calculations. Support is provided via WhatsApp, email, and the contact form during business hours (Saturday–Thursday, 10 AM – 8 PM GMT+6). Critical incidents are handled outside business hours on a best-effort basis.

9. Termination

You may cancel your account at any time from the dashboard. Cancellation stops auto-renewal; the Service remains active until the end of the paid billing period. We may suspend or terminate accounts that violate these Terms, with notice when reasonable. Upon termination, customer data is retained for 90 days for recovery, then permanently deleted.

10. Refunds

Refunds are governed by our Refund Policy.

11. Warranties & Disclaimers

The Service is provided "as is". We do not guarantee that every event will reach every ad platform — third-party platforms (Meta, Google, etc.) may reject events for reasons outside our control. We make no warranty regarding the marketing performance you achieve using the Service.

12. Limitation of Liability

To the maximum extent permitted by law, BonicBD's total liability for any claim arising from the Service is limited to the fees paid by you in the 3 months immediately preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or lost ad spend.

13. Changes to the Service or Terms

We may modify the Service or these Terms. Material changes are notified at least 14 days in advance via email or in-dashboard notice. Continued use after the effective date constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the People's Republic of Bangladesh. Disputes will be resolved in the courts of Dhaka, Bangladesh, except where mandatory consumer-protection law of your jurisdiction provides otherwise.
